Privacy Notice for Parking Administration

Data Controller:

Mole Valley District Council (MVDC) is the body exercising control over the purpose for which and the manner in which your personal data is processed.

MVDC is responsible for the management of the car parks within the district. Parking operations include day-to-day management, maintenance, enforcing parking regulations, administering parking charges, issuing car parking permits, dealing with unauthorised use of car parks and general enquiries.

In order to provide the above services, the Council is required to collect and process personal data and we are committed to protecting your privacy in accordance with the Data Protection Act and the UK General Data Protection Regulation (UK GDPR), which came into effect on 25 May 2018.

The legal basis for and the purposes of the processing:

If you have applied for a parking permit we have a legal obligation to process the information or your application.  If you have received a Penalty Charge Notice (PCN) or wish to appeal against one we have a legal obligation to process the information in connection with the PCN.

If you have contacted us and require us to reply to you, your information is needed to enable us to make contact with you.

The personal data processed will vary depending on the nature of the service used and may include:

  • details about you such as name, address, phone number, email address
  • details of your vehicle, such as registration number, vehicle make , model and colour
  • location of vehicle
  • civil parking offence details
  • blue badge serial numbers and expiry dates
  • formal parking enforcement notices and Police and Criminal Evidence (PACE) interview forms
  • vehicle ownership checks via the DVLA
  • images of you if the enforcement officer has activated their body worn video camera
  • your credit/debit card details if you have paid for a service by card
  • contact we’ve had with you, such as any correspondence

The above information will be collected to allow the council to provide specific car parking services and for the effective management of its car parks. In terms of car parking enforcement, the council has a legal obligation to enforce its parking regulations in accordance with the Traffic Management Act 2004 and Civil Parking Enforcement Statutory Guidance. We will not use your personal information for any other purposes such as marketing but reserve the right to use it for fraud investigations and for the prevention and detection of crime.

The source of the personal data:

For the purposes of parking enquiries, permits, PCNs and appeals you are the source of the personal data.

Recipients and categories of recipients of the personal data:

MVDC staff involved in the administration and management of parking services and/or community safety.

For parking enforcement, we will securely share information with the DVLA, the Traffic Enforcement Centre, the Traffic Penalty Tribunal (TPT) and the council’s appointed bailiff company for the purposes of administering and processing PCNs, in accordance with the council’s legal obligations and for the recovery of unpaid PCNs.

MVDC is under a duty to protect the public funds it administers, and to this end may use the information you have provided for the prevention and detection of fraud. It may also share this information with other bodies responsible for auditing or administering public funds for these purposes. This includes MVDC’s statutory participation in the Cabinet office’s National Fraud Initiative (NFI) data matching exercises. We will not share your information with any other organisations unless required to do so by law.

Further information on onward transfers:

MVDC will not transfer the personal data you have provided outside of the UK or European Union unless this is permitted in accordance with the Data Protection Act 2018

How long the personal data will be kept for:

The personal data you have supplied will be destroyed in accordance with MVDC’s Records Retention and Disposal Schedule.

Automated Decision Making:

The personal data provided by you will not be used for any automated decisions.

Data Subject Rights:

From 25 May 2018 you will have some specific rights in respect of your personal data. These may include some or all of the following rights to:

  • see what personal data about you MVDC holds at any time (subject to certain caveats, for example where third parties are identified);
  • have MVDC correct any errors (if any) in the personal data it holds about you;
  • request your personal data is erased (though this right will not apply where MVDC is processing your personal data because it is necessary to comply with a legal obligation);
  • Withdraw consent (see below)

Will the personal data be processed for a different purpose?

No. If MVDC needs to inform recipients about any action it has taken under the Data Protection Act then it will do so by placing a Notice on MVDC’s website informing the public of any relevant changes

The Mole Valley District Council website is maintained by MVDC. This privacy and cookies policy applies to information the council may collect from you when submitting information via an e-form. It does not apply to any sites the council links to.
