The legal basis for and the purposes of the processing:

MVDC carries out a Public Task in identifying empty properties and trying to bring those properties back into occupation. We carry out this role under legislation including S85 of The Local Government Act 2003.

We use the information that we collect to:

  • Establish who owns a property and their contact details ;
  • Engage specialist third parties to establish the contact details of the owners of empty properties;
  • Provide information on bringing properties back into use;
  • Engage with property owners to bring properties back into occupation;
  • Take action under relevant legislation to bring properties back into occupation, for example Empty Dwelling Management Order, Compulsory Purchase Order.

Data about the property, how it became empty and why it remains empty will be held. It will include contact details for relevant parties including the possible owners and impacted members of the public. This may include data about health and finance where it is relevant to a property being empty.

It may also include any data held in order to enable occupancy including legal actions.

The source of the personal data:

Personal data sources will include information from members of the public and property owners.

It will also include information from other relevant departments within the Council, for example (but not limited to) Council Tax, Environmental Health, Building Control, Planning and Legal Services.

Occasionally the Council may engage suitably qualified third parties in order to establish who owns a property or the owners contact details.

Recipients and categories of recipients of the personal data:

MVDC staff involved in the administration of bringing homes back into occupation.

MVDC staff in other Council Departments who require the information to carry out their functions for example (but not limited to) Council Tax, Environmental Health, Building Control and Planning.

Further information on onward transfers:

MVDC will not transfer the personal data you have provided outside of the UK or European Union unless this is permitted in accordance with the Data Protection Act 2018

How long the personal data will be kept for:

The personal data you have supplied will be destroyed in accordance with MVDC’s Data Retention Policy seven years after the empty property is considered to be occupied.

Statutory Obligations to provide the personal data:

There is no statutory obligation on you to provide any personal data about you, however, this may impact on the service that can be provided.

Automated Decision Making:

The personal data provided by you will not be used for any automated decisions.

Data Subject Rights:

From 25 May 2018 you will have some specific rights in respect of your personal data. These may include some or all of the following rights to:

  • see what personal data about you MVDC holds at any time (subject to certain caveats, for example where third parties are identified);
  • have MVDC correct any errors (if any) in the personal data it holds about you;
  • request your personal data is erased (though this right will not apply where MVDC is processing your personal data because it is necessary to comply with a legal obligation);
  • Withdraw consent (see below)

Will the personal data be processed for a different purpose?

No. If MVDC needs to inform recipients about any action it has taken under the Data Protection Act then it will do so by placing a Notice on MVDC’s website informing the public of any relevant changes
