Privacy Notice for Future Mole Valley Local Plan

The legal basis for and the purposes of the processing:
MVDC has a statutory duty to prepare a Local Plan as set out in the Planning and Compulsory Purchase Act 2004 and the Town and Country Planning (Local Planning) (England) Regulations 2012. Future Mole Valley is the title of MVDC's proposed Local Plan.
The Regulations require that, as part of preparing a Local Plan, MVDC needs to notify and invite representations from residents or other persons carrying on business within the district as well as from a range of specific and general consultation bodies that may have an interest in Future Mole Valley. The Act also requires MVDC to submit information relating to the representations made to MVDC on Future Mole Valley consultations onto the Secretary of State for Housing, Communities and Local Government for Local Plan examination.
MVDC is obliged to undertake public consultation on Future Mole Valley in line with its adopted Statement of Community Involvement 2016.

The source of the personal data:
For the purposes of Future Mole Valley public consultations, you are the respondent and are the source of personal data about yourself.
Personal information about you relating to you will not be collected from any other sources.
Recipients and categories of recipients of the personal data:
MVDC staff are involved in preparing the Future Mole Valley Local Plan and will be the recipient of your personal data.
During examination of the Future Mole Valley Local Plan, relevant personal data may also be shared with the Planning Inspector assigned to examine the Future Mole Valley Local Plan and his/her administrative staff for purposes of running the examination.

MVDC will not transfer the personal data you have provided outside of the UK or European Union unless this is permitted in accordance with the Data Protection Act 2018
How long the personal data will be kept for:
The personal data you have supplied will be destroyed, in accordance with MVDC's Data Retention Policy, six weeks after the Future Mole Valley Local Plan is adopted, or following the conclusion of any legal challenge to the Local Plan, whichever is the later. It is anticipated the Future Mole Valley Local Plan will be adopted in 2021, as set out in MVDC's Local Development Scheme.
Statutory Obligations to provide the personal data:
In most cases, there is no statutory obligation on you to provide any personal data about you. However, the Future Mole Valley e-newsletter is distributed by email, so if you choose not to provide an email address, we will be unable to send the e-newsletter to you directly.

At certain stages in the process of preparing Future Mole Valley, MVDC is obliged under the Town and Country Planning (Local Planning) (England) Regulations 2012 to obtain contact details for those who submit representations, in order to notify them about arrangements for subsequent stages of plan-making, including the independent examination of the Local Plan.

No. If MVDC needs to inform recipients about any action it has taken under the Data Protection Act then it will do so by placing a Notice on MVDC's website informing the public of any relevant changes
